Privacy Policy for Job Applicant

To comply with the Personal Data Protection Act B.E. 2562 and other applicable laws, including any future amendments to such laws (collectively referred to as the "Personal Data Protection Laws"), Jorakay Corporation Co., Ltd. (the "Company") has prepared this Privacy Notice (the "Notice") to explain in detail how your personal data is collected, used, and disclosed. This Notice applies to you as a job applicant with the Company and individuals associated with job applicants.

Definition

“Personal Data” Refers to information about an individual that can identify that person either directly or indirectly, excluding information about deceased individuals.
“Sensitive Personal Data” Refers to personal data related to race, ethnicity, political opinions, religious or philosophical beliefs, sexual behavior, criminal history, health information, disability, union membership, genetic data, biometric data, or any other information that could lead to unfair discrimination against the data subject or similarly affect the data subject as defined by personal data protection laws.
“Legal Basis” Refers to the legal grounds under which the collection of personal data is permitted according to personal data protection laws.
“Job Applicant” Refers to an individual who expresses an intention to be selected or interviewed for a contract with the Company as a permanent employee, temporary employee, or as a contractor or personnel in any other capacity working or performing duties for the Company and receiving wages, benefits, and other compensation, regardless of the title. This includes those who apply directly to the Company or through external recruitment agencies or other external organizations.
“Individuals Associated with Job Applicants” Refers to other individuals whose information has been provided to the Company by the job applicant, including but not limited to individuals referenced in the job application documents, the applicant's family members, and emergency contacts.

Types of Personal Data Collected by the Company

The Company will collect your personal data as specified in this Notice, either in whole or in part, as necessary to achieve the various purposes stated in this Notice.

Identity and General Contact Information Includes title, first name, last name, age, gender, date of birth, nationality, occupation, current address or registered address, photograph, signature, marital status, family status, telephone number, personal email, etc.
Documentary Reference Information Includes information from the resume (Curriculum Vitae / Resume), job application form, and other documents (e.g., additional documents related to the applied position).
Reference or Emergency Contact Information Includes title, first name, last name, relationship with the applicant, occupation/position, address, workplace, and contact details of the reference/emergency contact.
Education and Training Information Includes educational and training history, certificates of qualifications, language proficiency certificates, training and testing information, and activities participated in during education.
Employment Information Includes work skills, language skills, special knowledge, work experience and history, previous and current workplaces, duration of past and current employment, desired position and salary, and application date.
Interview Evaluation Information Includes evaluation of skills, comments on the applicant, and interview results.
Closed-Circuit Television (CCTV) Data Includes motion or still images recorded by the Company's CCTV cameras.
Supporting Evidence for Job Application Includes data appearing on copies of identification cards, passports, driver’s licenses, military service records, employment certificates, salary certificates, pay slips, house registration, name change documents, and related documents.
Sensitive Personal Data Includes religion, criminal history, health information such as weight and height, chronic diseases, medical examination results (doctor’s certificates), body temperature, and disabilities.

Note: In the event that you provide details about any third parties or if third-party personal data appears in documents that the Company collects from you under this Notice, you are responsible for informing the third parties about the disclosure of their information to the Company. Additionally, you must inform them of the details in this Notice that pertain to them.

Sources of Personal Data

The Company will collect your personal data from the following sources, both directly and indirectly:

Directly from You Through one of the following channels:
  • Verbal communication includes in-person conversations or phone calls.
  • Documentary communication includes job application forms, cover letters, resumes (Curriculum Vitae), or other documents related to the job application process with the Company.
  • Other communication channels includes emails, faxes, online communication channels such as job boards where you have provided your personal data for job applications, the Company’s website, the Company’s Facebook page, etc.
From Other Sources or Third Parties
  • Includes personnel of the Company who assist with coordinating your job application, recruitment agencies, individuals you have listed as references for your employment, other organizations where you have previously worked, and government agencies.
  • Includes job applicants related to you.

Purpose of Collecting Personal Data

The company will collect your personal data for use and/or disclosure solely for the purposes and under the legal basis as specified in this notice. If the company needs to collect additional personal data or use the personal data for purposes other than those specified herein, the company will inform you of the collection of such personal data and/or notify you of the new purpose of data collection. Additionally, the company will seek your consent for the collection, use, or disclosure of new personal data in cases where the law requires the company to obtain consent, in accordance with the provisions of data protection laws.

The background check of job applicants will be conducted through external individuals or organizations, including verification of qualifications as required by relevant employment laws, such as foreign labor laws and professions with legal conditions. This involve assisting in obtaining the necessary qualifications, such as applying for a foreign work permit or visa. Additionally, it includes checking and storing health information and other necessary data to assess the applicant's qualifications and suitability for the position, with the purpose of ensuring labor protection and workplace safety. Impact of Not Providing Personal Data

Job Applicant's Personal Data

The company collects your personal data to assess your qualifications and suitability for entering into an employment contract with the company. If you do not provide the necessary personal data, the company may not be able to accurately evaluate your abilities and suitability. In some cases, if the data is critical for the position you applied for, the company may decide not to hire you due to the lack of this information.

Personal Data of Individuals Related to the Job Applicant

If you do not provide the necessary personal data for evaluating the job applicant’s qualifications, the company may not be able to effectively assess the applicant’s suitability and may be unable to take appropriate actions for the applicant’s potential employment with the company.

Disclosure and Transfer of Personal Data Domestically and Internationally

To achieve the purposes of personal data collection specified in this notice, the company may need to disclose your personal data to individuals or organizations, including but not limited to:

  • Individuals or departments within the company, including executives, supervisors, employees, contractors, and/or internal personnel, as necessary for processing your personal data.
  • Service providers and agents hired by the company, such as companies providing ISO certification services.

Retention Period for Personal Data

Job Applicant’s Personal Data

The company will retain your personal data for as long as necessary for the consideration of entering into an employment contract with you. Once this purpose is fulfilled, the company will retain your personal data for the following periods:

  • If you are hired by the company: Your personal data will be retained for the duration of the employment contract and for up to 10 years after the contract ends.
  • If you are not hired by the company: Whether due to the company’s decision not to hire you or your decision not to accept the offer, the company will retain your personal data for up to 1 year from the date of the interview. If you have consented to the company retaining sensitive personal data for recruitment purposes, this sensitive data will also be retained for the same period.

Personal Data of Individuals Related to the Job Applicant

The company will retain your personal data for the same period as the job applicant’s personal data specified in this privacy notice.

However, this personal data may be retained beyond the specified period for purposes related to compliance with applicable laws and protecting the company’s legitimate rights or contesting allegations against the company. In such cases, the personal data will be retained for as long as necessary to fulfill these purposes and/or within the time frame required by law.

Your Rights Regarding Personal Data

You have the following legal rights regarding the personal data collected by the company:

  • Right to withdraw consent: You have the right to withdraw your consent for the collection, use, or disclosure of your personal data, in whole or in part, at any time during the period the company retains your personal data. Withdrawal of consent does not affect the legality of the data collection, use, or disclosure that occurred before the consent was withdrawn.
  • Right to access and copy personal data: You have the right to access your personal data and request a copy of it from the company. You may also request information about the sources of personal data that you did not provide directly to the company.
  • Right to request data portability: You have the right to request the company to transfer or send your personal data to another person or to yourself, in accordance with legal conditions.

  • Right to lodge a complaint: You have the right to file a complaint with the Office of the Personal Data Protection Committee if you believe that the company or its employees or contractors have violated or failed to comply with data protection laws.
